Distributor of Mobility Scooter Prevails Against City at Trial

On February 4, 2010 a Los Angeles County jury found in favor of Major’s Wholesale Medical Supply on a $2.7 million dollar products liability claim brought by the City of Norwalk. Shareholder William Kronenberg defended the case in which the City of Norwalk contended that a mobility scooter fitting the ADA definition of a common wheelchair was defectively designed leading to a serious injury sustained by a passenger on a Norwalk transit bus. The City of Norwalk paid the passenger $2.7 million and then sued the distributor, Major’s Wholesale, on a strict liability theory. The Honorable William Birney presided over the trial and entered judgment in favor of the client following a jury verdict that determined the product was not defective.
