Simone McCormick


Ms. McCormick represents businesses and professionals in commercial litigation, professional liability, privacy and employment matters.  Ms. McCormick handles disputes at all stages of litigation from inception to conclusion in state and federal courts as well as in administrative proceedings, including the California Labor Commissioner, U.S. Department of Labor, Department of Fair Employment and Housing, the Equal Opportunity Employment Commission, the Office of Civil Rights, Department of Consumer Affairs, and the Unemployment Insurance Appeals Board.

As a Certified Information Privacy Professional (CIPP/US) of the International Association of Privacy Professionals (IAPP), Ms. McCormick has represented businesses and professional clients in data incidents, which have included forensic investigations, multi-state notifications of affected clients and state Attorney General offices, the Office of Civil Rights of the Department of Health and Human Services and other governmental entities.  Ms. McCormick has also counseled clients in incident response planning, risk assessment, best practices in information privacy and data security, Board/manager/employee training and countering cyber incidents/threats.  Ms. McCormick also assists clients in contractual matters, preparation of specifically tailored policies, procedures, Business Associate Agreements, and handbooks and she conducts internal audits, trainings and investigations.


  • Defended multi-Plaintiff lawsuit against medical entity for numerous employment and other claims including false claims act violations, arising from the interpretation of the requirements of the Electronic Health Records Mandate under the 2009 American Recovery and Reinvestment Act.  The parties reached a confidential nominal settlement.
  • Assisted multiple professional service providers (legal, financial, medical) in data incidents which included forensic investigations, multi-state notifications of affected clients and State Attorney General offices and response to regulator inquiries.
  • Defended whistleblower, retaliation and wrongful termination lawsuit by former CEO against a medical entity and resolved the case by confidential settlement.
  • Achieved private settlement in a whistleblower claim alleging health and safety code violations and local health ordinances by an employee against a prestigious private club.
  • Reached a private and confidential settlement for the defendant, a law firm, in a sexual harassment lawsuit.
  • Achieved private settlement in lawsuit alleging disability discrimination and multiple wage and hour claims against private recreational club.
  • Settled professional liability claim against medical service provider while motion for summary judgment was pending.
  • Resolved Department of Labor investigation based on misclassification of workers against e-commerce Company and averted penalties and treble damages.
  • Defended multiple entities’ claims for discrimination, retaliation, harassment, failure to accommodate in EEOC, DFEH, and California Labor Commissioner Investigations resulting in dismissals or nominal settlements.

Representative Matters

  • Breach Coaching: Assist individuals and corporations, from local to international, of professional services (legal, financial, consulting and medical) and educational institutions in data incidents,  Specifically including lost devices, unsecured data, inadvertent disclosures, theft, external cyber threats which included forensics investigations, multi-state notifications of individuals and regulators.  Advise clients re privacy issues at litigation and pre-litigation stages.
  • Privacy/Cyber Security Counseling: Advise clients regarding state and federal statutory privacy requirements, PCI DSS requirements, EMV compliance, data disclosures, risk assessments/gap analysis, best practices, devise policies and procedures, conduct Board, manager and employee trainings, incident response planning, contracts preparation and review (Business Associate Agreements), risk mitigation strategies and business advice. Industries served include hospitality, health care/telemedicine, legal and financial service providers, consulting firm, e-commerce.
  • Defense in Administrative Proceedings: Routinely represent clients in administrative proceedings and government investigations including the DFEH, EEOC, OCR, for claims of discrimination, retaliation, wrongful termination and violation of civil rights.
  • Defense in Government Investigations: Represent clients in employee misclassification including the U.S. Department of Labor, California Labor Commissioner, the Equal Development Department and the Unemployment Insurance Appeals Board.
  • Litigation: Effectively and vigorously defend companies and professionals in litigation, including complex litigation, in state and federal courts, from inception to conclusion.
  • Employment Counseling: Advise clients regarding wage and hour and classification issues, on-boarding including contracts, reviews, policies and procedures, employment handbooks, reasonable accommodations requests, trainings, employee investigations, re-structuring and terminations.
