James F. Monagle

Mr. Monagle holds a Master of Laws (L.L.M.) degree in Intellectual Property, which is the primary focus of his practice.  Mr. Monagle handles litigation in both state and federal courts involving copyright infringement, trademark infringement and other trademark-based claims, patent disputes, trade secrets and related matters.  Mr. Monagle also handles copyright and trademark registrations, office actions, oppositions, monitoring, and maintenance for a variety of business entities and individuals, and has counseled clients regarding intellectual property protection, risk management, and business structuring. He regularly assists clients with regard to licensing issues, contracts, and general business matters. In addition to his intellectual property emphasis, Mr. Monagle's practice also includes the defense of professional liability matters, administrative actions, and appellate advocacy.

Prior to becoming an attorney, Mr. Monagle was a founder and executive in a start-up company.

Assisted client in obtaining defense verdict at trial involving copyright claims based on use of photographs of Marilyn Monroe for auction of items from Monroe estate; obtained attorneys fees award for client; defended against two separate appeals brought by plaintiff, currently awaiting opinions by Ninth Circuit.

Lions Gate Entertainment, Inc. v. The Urban Smalls Corporation et al
Represented multiple clients in defending against copyright and trademark claims based on clients’ parodic use of movie dialogue on baby clothing; dispute resolved amicably at mediation through use of licensing arrangement.

American Bevel, Inc. v. Masterpiece Leaded Windows Corporation et al
Represented multiple clients in defending against copyright claims based on beveled window design; dispute resolved amicably prior to trial.

Louis Vuitton Malletier, S.A. v. Jessica Cosmetics International, Inc. et al
Represented multiple clients in defending against copyright and trademark claims based on cosmetic packaging design allegedly similar to plaintiff’s protected design; dispute resolved amicably at mediation.
