R. Mick Rubio

Mr. Rubio is a defense litigator who brings a good-humored demeanor, but a quiet intensity to his practice. He defends against general liability claims for a diverse clientele which includes real estate professionals, attorneys, construction contractors and developers, commercial and residential landlords, products distributors, and private individuals. Mr. Rubio has successfully defended against a wide range of claims from legal malpractice, professional malpractice construction defect, products liability, and employment discrimination.

A disciplined attorney with a "measure twice, cut once" philosophy, Mr. Rubio prides himself with his cogent writing ability, genial nature, and his readiness to go above and beyond. On otherwise convoluted cases, he endeavors to simplify the complex to help garner favorable results for clients. Mr. Rubio is most proud of his early experiences in law school as a student attorney in the Elder Law Clinic providing aggressive pro bono counsel to low-income elderly clients in the Sacramento Region.

Mr. Rubio brings that same passion to his practice today. Outside of work, Mick enjoys cheering on his beloved San Francisco Giants and Golden State Warriors. His hobbies include modest attempts at playing guitar and piano, traveling, spending time with his wife, and spoiling his niece and nephew.

Representative Matters

  • In his representation of an attorney for legal malpractice, Mr. Rubio was the principal author of a successful "anti-SLAPP" (Strategic Litigation Against Public Participation) motion against the plaintiff. This resulted in the dismissal of Mr. Rubio's client, plus, recovery of the client's attorneys' fees and costs.
  • Authored a Motion for Summary Judgment which challenged the viability of a plaintiff's products liability claim. The Court ruled in favor of Mr. Rubio's client, effectively dismissing the client from plaintiff's suit.
  • In federal court, Mr. Rubio authored a successful Motion to Transfer Venue, effectively moving venue from one state to another, giving his clients a strategic and invaluable defensive advantage in the litigation.
  • Throughout discovery during a representation of a landlord entity in a residential habitability matter, Mr. Rubio helped to challenge the viability of plaintiffs' damages claims eventually forcing a favorable settlement
  • In his representation of a commercial landlord, Mr. Rubio challenged a pro per plaintiff's claims of improper eviction and other damages leading to a successful resolution of the matter at a mandatory settlement conference.
  • In his representation of a materials supplier in litigation involving alleged construction defects on a tract home development, Mr. Rubio drafted a Motion for Summary Judgment against a paving contractor who sued his client. The papers, harnessed by a well-researched and detailed expert declaration, resulted in a dismissal of Mr. Rubio's client before a hearing on the Motion.
